Thank you Ruth Danner for representing the people of Juneau and for asking a legitimate question.

 

On April 12, the Planning Commission approved a 10-year permit for Coogan construction to extract gravel and operate a rock crusher in a D3 residential area.

The commission also noted there was no opposition and is allowing crushing from 7 a.m. to 6 p.m. Monday through Saturday, even though there were at least 10 people present testifying otherwise and at least 15 letters opposing with concerns including water quality, Montana Creek watershed protection, noise and increased heavy truck traffic in a D3 neighborhood with over 300 homes.

According to the City Code 49.25 Art III, 4.150:

The allowable use of a rock crusher in land zoned D3 residential

“Must be in conjunction with an approved state or municipal public road construction project, and must be discontinued at the completion of the project. Road construction by private parties for subdivision development is excluded except as provided in this title. Rock crushed on-site must be used on-site. Crushing shall be limited to 8:00 a.m.—5:00 p.m. unless the director authorizes otherwise.”

Coogan’s request for a permit was approved by citing City Code: 49.65.200 Extraction permit required.

(a) The use of property for the excavation, removal or other extraction of stone, sand, gravel, clay or other natural deposits and formations, including the processing of the materials, may be authorized in any district only under a conditional use permit issued by the Commission under the procedures set forth in chapter 49.15, article III, as modified by this article.

Even this section states “conditional use” and in the supporting documents for adding this section to the land use code, the intent was only to allow for construction projects on a temporary basis. So the question remains, Mr. Mayor and Planning Commission members, why Coogan Construction was granted a 10-year permit to extract gravel and operate a crusher in an area zoned D3 on a non-temporary basis (10 years is not temporary) with no specific road project?
