Trial date set for man charged with death of four-month-old Rian Orr

A trial date was set Friday in Juneau court for the man accused of killing four-month-old Rian Orr.


Retired Fairbanks Superior Court judge Niesje Steinkruger set a two-week trial date beginning Feb. 21, 2012, for 22-year-old Juneau resident David Paul.

Bail was continued at $100,000 with a requirement that Paul cannot be released from Lemon Creek Correctional Center until after a court hearing sets conditions for his release.

District Attorney Dave Brower asked that a no-contact rule be imposed between Paul and the victim’s mother, Jackie Orr.

“I assume she is a witness?” Steinkruger asked.

“Well I don’t know about that,” defense attorney Eric Hedland said. “The state didn’t call her to grand jury. Your honor, the state didn’t ask for that at the initial appearance, the state didn’t ask for that when we were in court the following day and she was here. The state has been investigating this for about 10 months. Additionally, phone calls from jail are recorded. The cynical part of me wondered if the state intentionally didn’t ask for that in hopes that something would be said on the phone.”

Hedland said Orr was one of Paul’s only ties to the community here.

Steinkruger denied the no-contact request but issued an order that Paul could not discuss with Jackie Orr anything related to the case or about Rian Orr.

Orr has said that she did not see boyfriend Paul harm her child and believes the injury was an accident.

“I have no reason to believe he hurt my baby,” Orr said. “I have never had a reason to think he would hurt my baby ever, not once.”

Paul has been incarcerated at Lemon Creek Correctional Center since his arrest on murder charges July 8; he was arraigned the next day, and had a first appearance in court July 12.
