The state of Alaska and Michael P. Duby are expected to enter into a plea agreement in Juneau District Court on Wednesday. Duby, 37, currently faces seven charges related to hunting and fishing violations, along with making false statements on a Permanent Fund Dividend application. Here is a list of the counts against Duby, along with the resolutions proposed by the state.
(1) Black bear baiting without a permit
• Fine of $2,500
• Jail of 90 days with 70 suspended
• Forfeiture of all black bear hides seized
• Restitution for two black bears in the amount of $600 each
• Informal probation for a period of 10 years (Conditions: Revocation of hunting and trapping privileges for 10 years, may not accompany or assist anyone hunting or trapping in the state of Alaska for the period of probation)
(2) Illegal possession and transportation of game (black bear)
• Fine of $2,500
• Jail of 180 with 150 suspended
• Forfeiture of all black bear hides seized
• Forfeiture of bond paid for the fishing boat Huntress
• Restitution for four black bears
• Informal probation for 10 years (Conditions same as above)
(3) False statement on saltwater sport fishing logbook
• Jail of 60 days with 40 suspended
• Informal probation for five years (Conditions: revocation of sport fishing privileges for one year, revocation of sport fish guiding privileges for three years, may not accompany or assist anyone on a guided sport fishing trip for a period of three years and may not accompany or assist anyone on an unguided sport fishing trip for a period of one year)
(4) Assist client in violation of sport fishing regulation
• Fine of $2,500
• Jail of 90 days with 70 suspended
• Forfeiture of bond in the amount of $30,000 paid for the Huntress
• Informal probation for five years (Conditions same as above)
(5) False statement on Fish/Game application
• Jail 270 days with 180 suspended
• Informal probation for period of 10 years (Conditions same as Count 1)
(6) Assist client in violation of sport fishing regulation
• Fine of $3,500
• Jail 270 days with 190 suspended
• Informal probation for five years (Conditions same as counts 3 and 4)
(7) Unsworn falsification (PFD application)
• Jail of 365 days with 345 suspended
• Lifetime ban on applying for PFD
• Informal probation for period of three years

The DA and his darling, The Juneau Empire, must see fit to disclose the charges and proposed plea bargain publicly before the deal is even taken. A morsel thrown out to the public to scrutinize and even comment on before the case can go to trial... Or not. All this on the heals of a closed door plea agreement and sentencing of a child abuser whose charges were dropped with no explanation. Not to mention the defacto gag order implemented by the Empire in their comments forum. Yet the Empire will publish the victim's story sans comments. Of course the paper can't have any accessible forum steal their scoop. The author admittedly had his "I am SAM" piece in the making since December. The gag order continues. The public is welcome to rip Duby to shreds before his day in court but is disallowed comment on Officer Ervin post sentencing. Bassackwards. Dyslexic Judgement.
Not enough!
Duby and his fellow offenders should lose their guiding, hunting, and fishing privileges for the rest of their lives. In addition, everyone that comes in contact with them should let them know in public how disgusting their behavior is, and should refuse to do business with them.
I certainly will. And I'll write the court about how this sentence it far too lenient.
Too lenient
My faith in our government is diminished if Duby can be such a serial offender and still be a guide showing others how to hunt and fish in just three years (if I read this right). He should have to find a new career in my opinion.
