Local man arrested for accidentally discharging shotgun

Posted: April 14, 2012 - 3:03pm  |  Updated: April 15, 2012 - 12:09am

Police say a Juneau man was arrested early Saturday morning after inadvertently discharging a 12-gauge shotgun into the air while trying to unload the weapon.

Caleb Smith, 21, was arrested on suspicion of two counts of fourth-degree weapons misconduct and taken to jail, police said in a release.

Police said they received a report of a single gun shot in the area of Franklin and Second Streets at about 2:10 a.m.

Seconds after receiving the report, officers contacted Smith walking on Franklin carrying two rifles and a pistol, the release states.

Further investigation found he was under the influence of alcohol and inadvertently discharged the weapon, police say.

Online court records indicate Smith does not have a criminal history.

Gun kissers

These are EXACTLY the types of people who should be forever banned from ever owning a gun.

1. Drunk.

2. In a heavily populated area.

3. Carrying three guns.

4. Reckless.

Yeah, now where are all the gun kissers in this forum screaming that I'm wrong? (looking around the room). The silence is deafening.

So, whenever you right wing Fox TV blondes start screaming that Democrats want to take away all your guns (which we don't) we just want to take them away from drunks who can't handle them safely, like this guy.

The Second Amendment should be amended to read, "...the right of the people to keep and bear arms shall not be infringed, unless you are insane, drunk, or can't handle one safely and are a clear threat to society when you simply touch one."

This iz mah rifle,
This iz mah gun,
This one's fer huntin'
This one's fer fun,
This one's fer when I get drunk and bored and wanna walk around Franklin street so everyone can see it.

@Jo

I am not certain, but it is possible this drunken idiot is closely related to a certain left leaning Juneau Assembly Member and has done this sort of thing in the past. If that’s the case (and time will tell) then what we had was a drunken idiotic liberal with a gun…..

@ JE Fume

Wow. I love the Folk Fest. So do thousands of people in this town. It brings people from all over Alaska and my kids love to go dance there. It's free, there are lots of families, and it is a wonderful venue for our town to enjoy some good music. If you don't like the music, don't go. But, hey, it's nothing to start getting angry and insulting about.

I'm not sure how you took a story about some idiot with a gun and turned on the Folk Fest.
You might want to relax and rethink what you're typing before you post it.

Dear Jo M

I would like to know just how you are going to tell if a person is a drunk or not ??? So do you mean that anyone that has a drink can not own a gun ? How about owning cars ? I would think that you would want to know the same for car owners as more cars kill folks then guns so we better start putting a tat on the forehead of anyone that has been drunk so you can tell who they are? Anyone that fills out the 4473 and states that he is a drunk or insane can not buy that gun. Oh ya that would mean that they would have to tell the truth right I forgot daaaaaaaaa everyone always tells the truth right Jo! so now we have to not let anyone that has ever told a lie not buy a gun/ own a car ok I am sure that will work out well..........

felony or misdemeanor?

Which is Fourth Degree Weapons Misconduct?

If convicted as a felon, Mr. Smith would be prohibited from possessing a firearm, correct?

Maybe I'm just being nit-picky here...

The article and the press release on the JPD website both state that the man fired a shotgun, then SECONDS LATER was found carrying 2 rifles and a pistol. Where'd the shotgun go?

Hey Jo

There are no law abiding gun owners who would not condem the actions of someone like this, but more to the point we have laws and am sure the judicial system will do it's job. You are beyond an idiot with your rant.

Honest Mistake

Accidents happen, hence why they're called accidents. Just be glad that no one got hurt and Mr. Smith didn't decide to turn his guns on the officers. Which if he were a true menace to society he probably would have.

Don't follow you Nooj...

I'm afraid I don't follow you Nooj. We all have the right to bear arms thanks to the foresight of the Founding Fathers, but where was the accident?

Did this fellow accidently start drinking? Did the guns accidently fall into his hands?

I'd be the first to defend his right to own and use a gun, but not to abuse one.

There are no accidents when

There are no accidents when it comes to the unintended discharge of a fire arm. It is more like a negligent discharge than an accidental one. A trigger has to be pulled in order for a gun to go off. You don't want to fire a gun, don't pull the trigger.

These comments ,,,,

go beyond funny, bordering on plain ignorant.

Joe M. Usually your just obnoxious ,,,

Mediamatters, The same would apply to a person who knowingly drives to a bar, knowingly drinks, then knowingly drives home. They should be arrested for intentional DUI, intentionally causing an injury or death to another innocent driver or family.

Yet the public (you and most other posters on here) would poo poo it away because afterall he was driving drunk and it is ok because everyone does that right.

I vote for pre-meditated murder charges against anyone DUI that causes a fatality regardless.

Why does one get you insulted and the other is ok?

And as was mentioned the victim was accused of discharging a shotgun and yet seconds later was found with 3 weapons none of which were a shotgun.

Poor reporting by the paper or the cops or all the above.

Or maybe, just maybe, in thier zeal to find this evil doer they just grabbed the first person they saw with a weapon. You know the "officer i was robbed by a man in a green flatbed truck" and off they go and arrest the lady in a green Pinto scenario.

Yeah, grabbed the wrong guy right... like there was more than one guy walking around down town at 2:30 in the morning carrying a gun or guns right? Makes sense to me...

Failure to follow

It could have been? Under the poor reporting that we have to endure this could have all been an accident? For us as readers this is all speculation of which we're able to put our two sense in and that's mine.

For our forefathers also had the right mind to give us the freedom of speech and as such instead of creating a picket line of saying. This is why we should, shouldn't, what ever your stance is on gun control I'm just pointing it out.

No one got hurt, he was co-operative, and it 'could've' have been a mistake. And that's the big picture that wasn't followed.

Everyone can have an oppinion

Well lets see here....I personally know him, and he is one of the most responsible people that I have been around with a firearm of any sort. But, I will say he is dumb for A) Drinking and having the firearms in his car. B) Not having a case for them.(So many assuming people may think he's going to start shooting things/people up) C)??? Well you can decide on that. I've already told him he's damn lucky he didn't hit anyone. All you 'morons' out there calling him that have no room to talk, you don't know exactally what happened. Mr. Smith is very much aware of how bad it could have turned out. He was at the range earlier in the day and forgot to take them out of his trunk. At least nobody was hurt thankfully. He should have just left them in the car till he was sober. Last...what a pisspoor place to put a slide release; next to the trigger on the shotgun.
