Suspected marijuana grower indicted Friday

A local man arrested April 20 after police seized marijuana plants from his residence was indicted Friday by a grand jury.


Scott William Eberhardt, 28, now faces four felony drug charges.

According to the indictment, Eberhardt was indicted for knowingly possessing oxycodone, 25 or more marijuana plants and four ounces or more of marijuana, as well as for knowingly maintaining a residence used to keep or distribute controlled substances.

Those are all class ‘C’ felonies that can each carry up to five years in prison and a $50,000 fine.

Prosecutors charge authorities conducted a controlled delivery of a package addressed to Eberhardt that contained 40 tablets of 30 milligram oxycodone hydrochloride tablets. That’s commonly known as the painkiller Roxicodone.

Upon executing a search warrant at Eberhardt’s residence on Jennifer Drive in the valley, police found and seized 61 rooted marijuana plants found in Eberhardt’s bedroom and bathroom, according to an affidavit filed by Assistant District Attorney Angie Kemp.

The total processed weight of the marijuana was 10 ounces, Kemp wrote.

Until his arrest, Eberhardt was out on bail and awaiting sentencing in a similar case.

He pleaded guilty last month to misdemeanor drug misconduct after police seized 181 marijuana plants from his residence on North Douglas Highway in December. He was supposed to be sentenced in that case on May 10.

Eberhardt is next scheduled to appear in Juneau Superior Court Monday for his arraignment.
