BOZEMAN, Mont. — A 37-year-old Juneau fishing guide who pleaded no contest to hunting illegally in Montana has been given a 20-year suspended sentence.
District Judge Mike Salvagni sentenced Michael P. Duby on Monday and ordered him to pay $15,500 in fines and restitution.
Duby, his 62-year-old father, Michael W. Duby of Arizona, and a friend, 42-year-old Jeffrey C. Fritz of Washington, were charged after an investigation revealed that between 2004 and 2009 they illegally killed numerous large game animals in Gallatin County. The elder Duby and Fritz pleaded guilty to misdemeanor charges, but received no jail time.
The younger Duby pleaded no contest in April to four felony charges of illegal possession of game animals. The Bozeman Daily Chronicle reports he also is accused of breaking wildlife laws in Alaska.
Empire records reveal the younger Duby pleaded no contest in 2003 to charges of taking a brown bear in a closed area, hunting for brown bear without a guide, unsworn falsification, unlawful possession of a black bear, and false statements on three license applications. In 1999, he took a black bear under a false resident license.

Felony charges:
The key phrase here is felony charges. At least the younger Duby will have a felony conviction on his record which will strongly restrict his owner ship of a firearm, possession or even being in the presents of one. I agree w/KP they all should never be allowed to fish or hunt again in any state.

I totally agree with boletusak! This individual should have a huge black mark on his record that does not allow him to have a captains license, guide license, personal fishing or hunting license in any state, especially Alaska. He is basically receiving a slap on the wrist with just having to pay $15k. There is no check to get a fishing or hunting license that would show he has a felony on his record.
Not learning
This guy never learned about respect for the fish and game laws. He has repeatedly and blatantly violated not one, but two states' laws. Who knows where else he has been, Dads from AZ and his buddy is from WA. What has he done there? If he can't immediately pay his fines, start seizing assetts.

I am amazed and floored at the responses. Juneau has a serious morality problem! The man gets a 20 year suspended sentence for killing animals. You scream with empathy and compassion towards for the drunk that murders or Injures a person a Human. The dope dealing thief who destroys years worth of lives receives less fines and community service. But really what can be expected from this criminal town where if your not involved in dealing and killing most your family is. Mont. Has just made it clear they think more of their animals than Juneau thinks of their people. Give a poacher time and a drug dealer love. 1 thing you can say about the town you know the criminals your proud to be related to most of them, sick. I will be glad to leave even in areas where its riddled with gang activity there is shame associated with it, something Juneau is has never heard of. So what is the real reason to be hating on an animal killer, is he competition? I under stand the tree hugger, what about the rest of you. Its not like Juneau business wouldn’t dream of… not… lying cheating and manipulating to get a buck in their pocket. The commercial charter and sustenance fishermen in here are not exactly honest with their by catch. For the true sports man unless you’re an import I would bet very few of you have followed the hunting and fishing rules size area and bag limits its just not in your blood to have respect for anything that does not directly benefit you immediately.

Sure Duby should have learned his lesson and the judge went soft on him in Montana, but really how far is Duby from the average "sportsman" in SE Alaska. There is rampant subsistence hunting and fishing that is being sold or excessively traded that by far exceeds the intent of the law. How many other poachers are out there everyday with undersized kings, hi-grading halibut, failing to tag deer, or keeping king crab out of season. There is just too much illegal activity going on by the majority. Everyone is quick to jump on the band wagon and blame Duby, but how many people were there with him, knowing what was going on and failed to turn him in? People only speak up when it doesn't effect them directly. We all need to be better examples with our resources and hold each other accountable to following the rules!

Wow, all I can say is WOW! your grammar is atrocious and your comment was painful to read. You missed the point too. This article has nothing to do with drugs, alcohol, murder or the like. You are "amazed" that people condemn a professional guide for knowingly breaking numerous hunting laws? That "floors" you? Really? I don't disagree that many people may fudge on a under-sized King or maybe violate a law or two now and then. The reason there is an uproar is because Duby is (was?) a guide and as such, he should be held to a higher standard. When you make a living "Guiding" you must operate within the law. People expect guides to "guide" as in lead by example. This article would not be newsworthy if the violater was not a guide.

I agree, but don't be too loose with your thinking. There is a huge difference between not cutting a deer tag or shooting an undersized moose (frustrating, and we should do better but a mistake beginning hunters might make) and selling bear parts on ebay and killing multiple animals over multiple years without the proper permits. All the criticism of duby is warranted in my opinion. He should not be allowed to guide fisherman from out of state with his harvesting ethics, period.

Inform the public what this charter operator has been up to, and whether he will be allowed to continue fishing in our community or not.
I would like to have a chronological list of his wildlife offenses listed in an article so the public can accurately judge this person, who is obviously a problem charter operator. I would also like to know, for sure, if this person will still be allowed to operate at Auke Bay, or anywhere else around Juneau.
Having a real list of all this family's offenses is the only way the public can accurately understand this situation. I think it is in the public's interest to know what a problem charter operator is doing in the public domain. Without a comprehensive list, this story will end up being just a bunch of rumors, and that is of course, destructive and a major problem in Juneau.
I have also heard lots of 'rumors' of what the laws are in this case. Can he still captain a charter vessel as a convected felon? Can his dad drive the boat, who is apparently only convicted of misdemeanor? Can a convicted felon still work as a deckhand? Who is doing the bookings for this operator, allowing him to continue to operate in Juneau? Are most of his clients simply cruise ship passengers looking to kill some boredom on a afternoon in our town? What kind of fish do they catch? Do they target Rockfish?
All these are questions a lot of people in Juneau and on on the docks at Auke Bay are wondering about. The newspaper would be a good place for ALL the information to be accessible to everyone, so people can stop guessing and gossiping and really realize what the heck is actually going on on our docks.
I think we need a comprehensive article on this - a little investigative journalism is needed here...
