Bill would bar enforcement of new gun laws

JUNEAU — A bill introduced in the Alaska House on Wednesday would make it a misdemeanor for a federal official or agent to try to enforce any new restrictions on gun ownership.

HB69, from House Speaker Mike Chenault, was introduced the same day that President Barack Obama unveiled a package of executive orders and legislative proposals aimed at curbing gun violence.

Obama’s proposals, which follow last month’s deadly shooting at a Connecticut school, include background checks for all gun sales and a ban on assault weapons and high-capacity ammunition magazines. His 23 executive orders touched on such things as gun safety, background checks and mental health.

Chenault, in a news release, said work on his bill began before Obama’s announcement Wednesday.

“Tragedy is not a license for federal encroachment on constitutionally protected freedoms,” he said. “We can all agree that what happened in Newtown, Conn., was an absolute tragedy. But what we fundamentally disagree on is how you meet the challenge it presented.

“The president is using it to further his liberal agenda to try and disarm and disenfranchise law-abiding Americans from their enshrined Second Amendment rights,” he said. “No one should be comfortable with that, regardless of where you sit on the issue.”

His bill would deem unenforceable federal laws, orders, rules or regulations enacted or effective on or after the effective date of his bill that seek to ban or restrict ownership of a semi-automatic firearm or magazine, or that require a firearm, magazine or firearm accessory be registered. The bill says any federal official, agent or employee who tries to enforce any such provisions is guilty of a Class B misdemeanor.

Chenault, R-Nikiski, said he is building on a measure that passed the state Legislature in 2010, that exempted personal firearms, accessories or ammunition manufactured in Alaska from federal law or regulation, including registration.

HB69 has an immediate effective date, but Chenault plans to work with a House committee to make the effective date retroactive to Jan. 1, should the bill pass.

The measure had at least 11 Republican co-sponsors by late Wednesday afternoon.

I find it hilarious that most of the hard-on-for-gun nuts usually say something along the lines of "you're spouting out lies! do some research before you talk!" But continue to tell the 2 million a year fairy tale.

When glacierdogs first mentioned that story, he also said we were spouting out lies and not doing research. So, I decided to do research and found out that glacierdogs should've practiced what he preached.

David Frum is not credible

That's a very biased article with selective use and misuse of data. Just google David Frum guns and you can figure what this guy is about. He's basically just another anti-gun left wing mouthpiece.

Oh and of the 36% estimated cases that were not reported to police you can add one burglar in CO that was breaking though a skylight in pitch darkness. When verbally informed of the precariousness of his situation his reaction would have impressed Jessy Owens in getting off the roof. The subsequent rooftop leap and crash into garbage cans, combined with the cursing and limping noises as he retreated forthwith indicated that an armed home owner was in fact a deterrent.

Then again.. that is "old data".

PRETTY SAD

I find it really interesting that people are so worried about statistics and studies and totally forget about the Constitution.
There was a reason the wording was placed as it is,suggest you pay attention to the commas and period.
There is also another one

All the above can be obtained if you have the $$$$

The 2nd amendment is interpreted multiple ways so for you to say you interpret it correctly while others don't suggests you don't fully understand the magnitude of the situation. As for tanks and other military grade equipment, sure, you can own them. Just like you can own nukes without any uranium or means of propulsion. You can't have the ammunition for the military grade equipment unless you have federal authorization and as a civilian you most likely wouldn't. It's highly regulated in case you hadn't noticed. This nationwide discussion is about further regulating arms. The constitution mentions that specifically so I suggest you take your own advice and take a another glance at it. As for piers morgan being a communist, I'm guessing you throw that term around frequently without understanding the meaning.

This goes for all the commenters who are freaking out over the proposals made by obama. No one is taking away our second amendment right. It's already regulated and the proposal is for further regulation. Let's tone down the rhetoric and wipe the froth from our faces. No one is disarming us. Discuss it reasonably or prepare to be ignored.

the fact is the 2nd amendment is very clear and there is absolutly no need for any more regs or attempts at such!
Enforce what is and move on,cannot regulate mentally unstable and you sure cannot change the writing of the Constitution.

I find the anti-gunners to be a depressing bunch. Anyone else would look at the US consitution and be in awe of it. When you look at the strength of the people that established it and those that have defended it over the years it just seems wormy and sniveling to give up any freedom that Americans possess.

Democracy is messy so what - appreciate what you got. Appreciate the consitutional freedoms you have nowhere else in the world. Quit trying to chisel the thing down.

one funny fact is...

Gun grabbers using phrases like "angry gun advocates" "wipe the froth from your mouths" or accusing of "rhetoric" is extremely hypocritical. (big surprise there) If you take the time to read through all the comments you will notice that Americans speaking up for the constitution are for the most part very civil. But when you compare that to what the gun grabbers are saying you will notice that they are the ones that are angry, frothing from the mouth, name calling , spouting rhetoric and advocating for violence.

Dont believe me ? Read all the comments though this single article again and others on the same topic in the Juneau Empire forums. And keep that in mind when you read through forums on a national news source.

I stand by the statistic that guns are used by Americans in the US up to 2 million times a year to prevent a crime, usually without firing a shot. It would not surprise me at all if the number is actually much higher because just like people having to shoot brown bear for defense, it's usually not reported to authorities.

The Bill of Rights doesn't grant rights but merely states that those rights exist. Americans have a right to keep and bear arms, and that exists with and without the Bill of Rights. And that is what the Constitution says. We don't need a church, let alone a government church, to practice religion, we don't need a forum, let alone a government forum, to practice free speech, and we don't need a government organization to practice the right to keep and bear arms. It's only after these many years that I realize the value of a good education, and if the people who worked so hard to give me that education were still with us I would thank them.

I went to the actual study and it sure looks like BS to me.

It reports that 8% of the time people using a gun actually shoot the perp.

.08 x 2,000,000 = 160,000 shootings a year. With guns responsible for about 10-11 thousand deaths per year in the USA that seems to indicate a very low kill rate. A UN study shows in 2010 about 53,000 deliberate injuries from guns.

One of Obama's executive orders was to allow the US Government to study gun violence. You see, Federal money was barred from being used to study gun violence. Why? Gun “advocates” think any money spent on studying gun violence is advocacy for gun control.

Obamas proposals are not onerous, do not take away guns, and start the ball rolling on what we need to do to stop us from killing each other.

Here's my big point...

Other places have guns. Other places have violent media. Other places have mental health issues.

Why is it Americans kill Americans so much more than those other places?

If we can answer that question we can start to figure out how to stop the slaughter of innocent people living their lives.

It's just not worth the time in here (in this forum). I pointed out that walking around brandishing firearms is not a healthy thing for a civil society. This conclusion is based on my opinion that brandishing a firearm implies violence. In the opinion of Mr. XXL Man, that makes me a “wack job”.

It just makes me think of the quote attributed to George Carlin, “Think of how stupid the average person is, and realize half of them are stupider than that.”

I did as you suggested and read through all the comments on this subject through the JE forums. Your observation is correct about who is doing most of the name calling, immature ranting and calling for violence. And I will point out Superhero, HanSolo, Swimmergirl and the newest hate filled comment submitted by the angry "humanbeing".

I will also point out that you also have called superhero a derogatory name as well. On that note, Superhero and others that share the same view point's have been much more outspoken with their immaturity and ugly nonsense speak than any of the folks standing up for everyone's right to keep and bear arms.

Thanks for pointing that out, it speaks loudly to who the "whack jobs" really are.
