Alaska analysis supports health care overhaul

JUNEAU — A legal analysis by the Alaska Legislative Affairs Agency says court rulings against the federal health care overhaul do not apply to the state.

The analysis, which was requested by Democrat Sen. Hollis French of Anchorage, says rulings by lower courts against the overhaul do not set precedent in Alaska.

Gov. Sean Parnell has cited rulings from two courts outside of Alaska as justification for not instituting last year’s overhaul.

However, since none of these courts are located in Alaska, the analysis says, their rulings do not hold jurisdiction in the state and therefore do not have to be abided by.

A spokeswoman for Parnell did not immediately respond to a request for comment.
