Judge hearing Palin case recuses himself

ANCHORAGE - A judge handling a lawsuit against Alaska Gov. Sarah Palin for using private e-mail accounts for government business has recused himself.

Oral arguments had been set for Wednesday. But Superior Court Judge Craig Stowers recused himself after becoming one of 25 candidates for a vacancy on the Alaska Supreme Court. Palin will make the final selection for the high court from a list of finalists submitted by a nominating panel.

Anchorage resident Andree McLeod is suing Palin to make sure government e-mails sent from her private account are archived in the state system and available for public records requests. Stowers also recused himself from McLeod's appeal of a state decision to withhold state e-mails that were copied to Palin's husband, Todd, as "executive privilege" even though he is not a state employee.

McLeod's cases have been reassigned to another judge.
