KODIAK - A Kodiak grand jury has indicted two men on charges of second-degree murder in the 2008 slaying of a 41-year-old man.
Charged this week in the death of Darrell Cavaness were Chawn (shawn) D. Summerall and Joshua R. Erickson.
Summerall was previously charged in the killing in June 2009 but that indictment was overturned last month by Superior Court Judge Fred Torrisi. The judge ruled that the indictment relied too heavily on hearsay evidence and also said evidence was withheld from the grand jury.
Summerall and Erickson are accused of beating Cavaness into unconsciousness on the night of Jan. 22, 2008. He died in an Anchorage hospital a week later due to severe head injuries.
Summerall is currently jailed on an unrelated felony DUI charge, but Ericksons whereabouts are unknown. A warrant has been issued for his arrest.
