Judgments
Virgil W. Kellton, 26, was indicted by a Juneau grand Jury on a felony charge of drunken driving stemming from an offense of Aug. 2 in Skagway.
Kellton has two prior drunken driving convictions since 1996. According to Alaska law any new drunken driving charges are considered felonies.
The grand jury also charged Kellton with driving with a canceled, suspended or revoked license stemming from an offense of Aug. 2.
Janet Austin Lincoln, 21, was found guilty in Juneau Superior Court of fourth-degree misconduct involving a controlled substance and second-degree misconduct involving a controlled substance, both felonies, stemming from an offense of Dec. 26.
Superior Court Judge Patricia Collins sentenced her to 24 months in jail with 19 months suspended and placed her on probation for three years with the standard conditions of a felony release which includes committing no crimes, violating no laws, completing the sentence, paying a surcharge and the cost of incarceration, not associating with known felons, not owning any firearms, not consuming alcohol or drugs and not going where they are sold or served and making and effort to maintain employment.
Victor D. Austin, 42, was found guilty of second-degree sexual abuse of a minor, a felony, stemming from an offense of the winter of 1996 and 1997.
Collins sentenced him to 10 years in prison and he must register as a known sec offender.
Paul S. Olmsted, 36, was found guilty of drunken driving, a misdemeanor, stemming from an offense of Aug. 23.
Magistrate John Sivertsen sentenced him to spay a fine of $3,000 with $1,500 suspended, 180 days in jail with 160 days suspended, a one-year driver's license revocation, Juneau Alcohol Safety Action Program participation and placed him on probation for one year with the standard conditions of release which include committing no crimes, violating no laws, completing the sentence, paying a surcharge and the cost of incarceration.
He also was found guilty of driving with a canceled, suspended or revoked license stemming from an offense of Aug. 23.
He was sentenced to 10 days in jail and a 90-day driver's license revocation.
A charge of refusing to submit to a chemical breath test stemming from an incident of Aug. 26 was dismissed by the state.
Richard Banon, 43, was found guilty of refusing to submit to a breath test, a misdemeanor, stemming from an offense of Aug. 19.
Sivertsen sentenced him to pay a fine of $3,000 with $1,500 suspended, 46 days in jail with 40 days suspended, a 90-day driver's license revocation, JASAP, and placed him on probation for one year with the standard conditions of release.
He also was found guilty of two counts of violating the conditions of his release, a misdemeanor, stemming from an offense of Aug. 21.
He was sentenced to pay a fine of $8400 with $400 suspended, 30 days in jail with 30 days suspended, comply with recommendations of the Juneau Alliance for Mental Health Inc. and placed him on probation for one years with the standard conditions of release.
Charges of drunken driving and harassment were dismissed.
Scott Higgins, 39, was indicted by a Juneau grand jury on one count of first-degree burglary, a felony, and third-degree theft, a misdemeanor, stemming from an incident of Aug. 21.
He is accused of entering a dwelling with the intent to commit a crime and then allegedly stealing a guitar, valued at $50 or more.
Trevor Prather, 19, and John Vavalis, 20, were indicted by a Juneau grand jury on two counts each of second-degree theft, a felony, stemming from an incident of Aug. 23.
They are accused of stealing goods or services from Fred Meyer valued at more than $500 but less than $25,000.
Arthur E. Hughes, 32, was found guilty of disorderly conduct, a misdemeanor, stemming from an offense of May 21.
He was charged originally with misdemeanor assault.
Sivertsen sentenced him to pay a fine of $500 with $250 suspended, 30 days in jail with 27 days suspended and placed him on probation for one year with the standard conditions of release.
A charge of violating the conditions of his release, a misdemeanor, stemming from an incident of July 8 was dismissed.
Charles Littlefield, 30, was found guilty of felony drunken driving and eluding a police officer, also a felony, stemming from an offense of April 18.
Superior Court Judge Larry Weeks sentenced him to five years in jail with three suspended and sic months for violating the conditions of his release from a previous conviction. He also was placed on four years of probation with the standard conditions of felony release.
Robert E. Kenney, 36, was found guilty of disorderly conduct stemming from an offense of May 19.
He was charged originally with assault - recklessly cause injury.
Sivertsen sentenced him to pay a fine of $1,000 with $250 suspended, 45 days in jail with 45 days suspended, JASAP and placed him on probation for one year with the standard conditions of release.
Annmarie E. James, 26, was found guilty of disorderly conduct stemming from an incident of June 16.
She originally was charged with assault.
Sivertsen sentenced her to pay a fine of $500 with $250 suspended, 30 days in jail with 23 days suspended and placed her on probation for one year with the standard conditions of release.
She also was found guilty of resisting arrest stemming from an offense of June 16.
She was sentenced to a $500 fine with $500 suspended and 30 days in jail with 30 days suspended.
A second assault charge stemming from an incident of June 16 was dismissed.
Michael A. Bernstein, 24, was found guilty of drunken driving stemming from an offense of Sept. 3.
His blood alcohol level was 0.109 percent. The legal limit to be able to drive is 0.08 percent.
Sivertsen sentenced him to pay a $3,000 fine with $1,500 suspended, 33 days in jail with 30 days suspended, a 90-day driver's license revocation, JASAP and placed him on probation for one year with the standard conditions of release.
Douglas D. Courtney, 36, was found guilty of drunken driving stemming from an offense of July 29.
His blood alcohol level was 0.142 percent.
Sivertsen sentenced him to pay a $3,000 fine with $1,500 suspended, 33 days in jail with 30 days suspended, a 90-day driver's license revocation, JASAP and placed him on probation for one year with the standard conditions of release.
Zack Williams, 18, was found guilty of larceny of money or property, a misdemeanor, stemming from an offense of Aug. 24.
Sivertsen suspended imposition of sentence and placed him on probation for one year with the standard conditions of release.
Jesse A. Herman- Haywood, 18, was found guilty of drunken driving stemming from an offense of July 4.
Sivertsen fined the defendant $3,000 with $2,250 suspended, 90 days in jail with 70 suspended, a one-year driver's license revocation and placed the defendant on probation for one year with the standard conditions of probation.
Herman-Haywood also was found guilty of violating the conditions of probation stemming from an offense of Sept. 4.
Sivertsen imposed a sentence of $250 with $250 suspended, 30 days in jail with 30 days suspended, JASAP and one year of probation with the standard conditions of release.
A charge of refusing to submit to a breath test stemming from an incident of July 4 was dismissed.
Jeffrey Anderson, 24, was found guilty of fourth-degree misconduct involving a controlled substance, a felony, stemming from an offense of Dec. 30.
Weeks sentenced him to three years in jail with one year suspended and three years of probation with the standard co nditions of felony release.
Thomas E. Smalley, 26, was found guilty of fourth-degree misconduct involving a controlled substance, a felony, stemming from an offense of April 26.
Weeks sentenced him to three years in jail.
