Judge will decide whether to halt probe

ANCHORAGE - A judge will hear arguments this week on whether he should halt an abuse-of-power investigation by the state Legislature into Gov. Sarah Palin.

Anchorage Superior Court Judge Peter Michalski has scheduled a hearing for Thursday in the lawsuit filed by five Republican lawmakers.

The legislators want to block the Legislative Council's investigation into whether Palin acted improperly when she fired Public Safety Commissioner Walt Monegan this summer. Palin denies she pressured Monegan to fire a state trooper who had gone through a bitter divorce with her sister.

None of the five legislators asking for a temporary restraining order are on the Legislative Council, which unanimously approved the probe. They say the investigation has been tainted by partisan politics as Election Day approaches.
